§1. About Seen Live (analytics-only positioning)
Seen Live is an analytics tool that detects, structures, and surfaces public plays of your music — DJ sets, lives, edits — across YouTube, Instagram, and TikTok. We do not collect royalties, do not file copyright claims on your behalf, and do not initiate any automated legal action. Detections are informational. Acting on them — contacting venues, building setlists, or escalating misuse — remains entirely your decision.
§2. Beta scope and access
This beta is private and limited to a group of invited artists. The beta is desktop-only (≥1024px viewport). Mobile, tablet, and the public version are scheduled for Phase 2. Visitors arriving via mobile are redirected to /mobile-redirect. Non-whitelisted email addresses requesting a magic link are politely informed at /auth/not-on-list.
§3. Master rights certification
By uploading a track, you certify under penalty of perjury that you own or control the master rights of that track and that you have the authority to submit it to detection scanning. You agree to indemnify Seen Live and its operators against any third-party claim arising from a fraudulent upload (a track for which you are not the master rights holder). Seen Live reserves the right to suspend any account in case of credible third-party claim, with or without prior notice (see §5).
§4. Track lifecycle and retention
During the private beta, your uploaded MP3 files are stored as long as the track is being tracked, plus a security buffer after account deletion. Your audio fingerprint (a non-reversible signature) is retained indefinitely for continued scanning. A future automatic purge policy for uploaded MP3 files will be introduced ahead of the public opening (Phase 2).
§5. Takedown / DMCA / LCEN workflow
Seen Live operates a takedown procedure compliant with French LCEN art. 6 and U.S. DMCA safe-harbor (17 U.S.C. § 512). The single point of entry is privacy@seenlivemusic.com. The workflow follows seven steps:
- Entry point. Notice received at privacy@seenlivemusic.com (LCEN art. 6.I.5).
- Claimant verification — proof of identity and of rights claimed.
- Prompt action. Verified notices are processed promptly, in line with LCEN art. 6 obligations.
- Soft flagging applied where the alleged content presents a reputational risk to the rights-holder pending review.
- Notification sent to the artist with a counter-notification window (process mirrors DMCA § 512(g)).
- Register kept for the duration required by applicable law (LCEN obligation).
- Jurisdictions distinguished. DMCA § 512 governs U.S.-originated notices; LCEN art. 6 governs France/EU notices. Single entry point, distinct legal tracks downstream.
§6. Cookies and analytics
We use an EU-hosted product analytics SDK. Tracking is opt-out by default — no event is sent until you explicitly accept via the consent banner. You can revoke consent at any time by clearing your browser storage or by emailing privacy@seenlivemusic.com. Full details in our Privacy Policy §7.
§7. Limitation of liability (beta)
Seen Live is provided as is during the beta. Detection accuracy depends on our third-party detection provider. False positives, false negatives, missed plays, and brief outages are part of the experimental nature of this phase. We document our pipeline health publicly via /api/health.
§8. Termination
You may terminate your account at any time by emailing privacy@seenlivemusic.com (RGPD right to erasure, processed within 30 days). We may suspend or terminate your account in case of CGU violation (§3 fraudulent upload, abuse of the platform, or imminent legal risk).
§9. Governing law
These Terms are governed by French law. The competent courts are the French courts of the editor's place of domicile for any dispute that cannot be resolved amicably first via privacy@seenlivemusic.com.
